At the outset, it has been fairly submitted at the Bar that the issue involved in the present writ petition has come up for consideration before the learned Division Bench of this Court in the case of Devmuni Paswan Vs. The State of Bihar & Ors, reported in 2023 (2) PLJR 425 wherein the declaration of Clause 5 (7) of Bihar Chaukidar Cadre (Amendment) Rules, 2014 being held ultra vires in violation of Articles 14 and 16 of the Constitution of India. The challenge to the decision rendered by the Division Bench also failed before the Apex Court.

3. In view of the aforesaid facts, no relief can be
