2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 96 of the B.N.S.

3. The case of the prosecution, in short, is that, the minor daughter of the informant (x) has gone to ease herself at 12:00 P.M., when she did not return for a considerable moment, she was being searched. During search, the informant came to know that the petitioner along with others has kidnapped his minor daughter for the purpose of marriage.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence. It has further been submitted that the statement of the victim girl

No.82955 of 2025(2) dt.10-12-2025 2/3 was recorded under Sections 183 of B.N.S.S., wherein she has clearly stated that no occurrence of kidnapping has taken place and she has gone to the house of her aunt. It is further submitted that the statement of the victim itself exonerates all the accused person including the petitioner. Similarly situated co-accused person has already been granted bail by a Co-ordinate Bench of this Court vide order dated 12.08.2025 passed in Cr. Misc. No. 53504 of 2025 and the case of this petitioner stands on similar footing. It has also been submitted that the petitioner has clean criminal antecedent as stated in para 3 of the bail petition. Moreover, the petitioner is languishing in judicial custody since 10.07.2025.

5. Learned counsel for the informant and learned APP appearing for the State have vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chausa P.S. Case No. 258 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M.,
