This is an appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer for bail by order dated 22.10.2019 in SC/ST Case No.108 of 2019 arising out of Sahar P.S.Case No.187 of 2019 passed by the learned 1st Additional Sessions Judge, Bhojpur, Ara, registered under Section 302 of the Indian Penal Code and Section 3(1)(r)/3(2) (v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. The chargesheet has been submitted bearing No.134 of 2019 dated 13.10.2019 for the offence under Section 304 I.P.C. and 3(1)(r)(s)/3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Considering the nature of allegation disclosed

Patna High Court CR. APP (SJ) No.5320 of 2019(4) dt.17-02-2020 2/2 against the appellant and the fact that the appellant is not a qualified Doctor, I am not inclined to enlarge the appellant on bail. Hence, prayer is refused.

The learned Trial Court is directed to expedite the trial and conclude the same preferably within nine months. Accordingly, this appeal stands dismissed.
