====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 10-12-2025 Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners apprehend their arrest in connection with Ramgarh P.S. Case No. 328 of 2025, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.
3. The recovery is of 4.400 litres of illicit liquor from the house of the petitioners.
4. Learned counsel for the petitioners submits that they are willing to donate Rs. 25,000/- to a charitable organization without admitting their guilt.
5. Learned APP appearing for the State opposes the
Patna High Court CR. MISC. No.82887 of 2025(2) dt.10-12-2025 2/3 prayer for bail of the petitioners.
6. Considering the aforesaid facts, this application is allowed.
7. Let the petitioners, named above, in the event of their arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing a bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise-II, Kaimur at Bhabua / concerned Court below in connection with Ramgarh P.S. Case No. 328 of 2025, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of BNSS.
8. This is also subject to the condition that the petitioners shall deposit an amount of Rs. 25,000/- in Ram Krishna Mission Ashrama, Luxa, Varanasi, Uttar Pradesh and produce the receipt of the same before the Court below. The bail bonds of the petitioners shall be accepted only after verifying the genuineness of the receipt produced.
9. As a condition of this order, the petitioners, after being released on bail, are directed to mark their attendance at Ramgarh Police Station every Sunday of each month. Any default in appearance at the police station will result in the
