2. The petitioner seeks bail in a case registered for the offence under Section 8©/21-B of the NDPS Act.
3. As per the prosecution case, 11.60 grams of smack has been recovered which is of intermittent quantity.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Petitioner claims clean antecedent and he is in custody since 19.10.2023.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the facts and circumstances of the
Patna High Court CR. MISC. No.3150 of 2024(2) dt.31-01-2024 2/2 case, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions-cum-Special Judge, NDPS Act, Araria/concerned court below in connection with Special Case No. 101 of 2023 arising out of Kursakanta P.S. Case No. 249 of 2023 subject to the condition that:- 7(1). The petitioner will mark his attendance at the Sikty, Araria Police Station/local police station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
