The petitioners apprehend their arrest in Mahila P.S. Case No. 19/2018, instituted for the offences punishable under Sections 353, 354, 341 and 342/34 of the Indian Penal Code. Earlier prayer for anticipatory bail of the petitioner was rejected vide order dated 19.06.2018 passed in Cr. Misc. No. 26842/2018.

Learned counsel for the petitioner has submitted that after rejection of the bail petition, victim Puja Devi is living with petitioner no. 2.

Since prayer for anticipatory bail of petitioner was earlier rejected on merit this Court is not inclined to grant

Patna High Court Cr.Misc. No.61136 of 2018 (2) dt.03-10-2018 2/2 anticipatory bail to petitioner.

This petition is disposed off with direction to petitioner to surrender before the Court below within four weeks from the date of receipt/production of copy of this order along with the victim girl and pray for regular bail, which shall be disposed off by the court below in accordance with law after taking into consideration that compromise has been entered between the parties and victim girl is living with petitioner no. 2, preferably on same day.
