ANJANA MISHRA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Nalanda P.S. Case NO. 87 of 2018 for the office registered under Sections 399, 402, 120(B) of the Indian Penal Code and Section 25(1-b)A, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that name of the petitioner has surfaced in connection with the present case on the basis of the confessional statement made before the police by one Rajesh Kumar from whose house alleged recovery has been made. The allegation against the petitioner is that he was one of the members, who were planning to commit an offence and had been present at the place of occurrence, when the police conducted

Considering the aforesaid facts and circumstances of the case and that the name of the petitioner has surfaced on the basis of the confessional statement made before the police, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Nalanda P.S. Case No. 87 of 2018, subject to the condition as laid under Section 438(2) Cr.P.C.
