====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 103 and 3(5) of the B.N.S., 2023.
3. As per the prosecution case, son of informant had gone to take bath at Ganguli Lakh where on the instigation of Raja Kumar, all eight accused persons, including the petitioner, allegedly assaulted the son of the informant with lathi, danda, and iron rod.
4. Learned counsel for the petitioner submits that informant is not an eye-witness to the occurrence. As a matter of fact, the son of informant after consuming liquor fell into canal and sustained injuries and during treatment died. As per the
Patna High Court CR. MISC. No.82843 of 2025(2) dt.02-12-2025 2/2 postmortem report, the deceased sustained only two external injuries. The petitioner is in custody since 28.06.2025, and the charge-sheet has been submitted in this case.
5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.
5. Considering the nature of the accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.

Accordingly, let the above-named petitioner be released on bail on furnishing a bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Rohtas at Sasaram, in connection with Dalmianagar P.S.
