The petitioner apprehends her arrest in connection with Excise Act Case No. 1692 of 2018 arising out of Excise Complaint Case No.194 of 2018 registered for the offences punishable under Sections 30(a) and 30(c) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is recovery of 7 liters of country made liquor from the Car of the petitioner. Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner and the petitioner has got no criminal antecedent.

No.77710 of 2019(2) dt.29-11-2019 2/2 In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, subject to deposit of Rs.5,000/- in the court below/ Nazarat and on deposit of the aforesaid amount, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, the court below shall release him on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge Iind, Madhepura in connection with Excise Case No.1692 of 2018 arising out of Excise Complaint Case No. 194 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C. Such deposit of Rs.5,000/- shall abide by the outcome of the criminal case.
