The petitioner is languishing in custody since 25.09.2019 in a case registered for the offences punishable under Sections 341, 323, 324, 326 and 307/34 of the Indian Penal Code.

The prosecution case is that in the background of some dispute with regard to demanding goods on credit from the son of the informant, this petitioner gave 3 knife blow to the informant.

It is submitted by learned Senior counsel for the petitioner in the background of some bonafide dispute, the accusation has been levelled. The petitioner is accused in one

Patna High Court CR. MISC. No.79222 of 2019(2) dt.04-12-2019 2/2 more case but he is on bail in that case. It is further submitted that the injury has been found superficial simple in nature. Hence, it does not suggest that there was any intention on the part of the petitioner to kill the informant. Learned APP submits that the accusation is specific against the petitioner.

Considering the fact that the injury has been found simple in nature and period under custody, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Danapur, District - Patna in connection with Danapur P.S. Case No. 495 of 2019.
