JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-07-2019 This is an application for grant of anticipatory bail in connection with Giriyak P.S. Case No. 183 of 2018, disclosing offences under Sections 302, 201, 120B of IPC. Prosecution story as per written report is that the son of the informant has gone to his Sasural along with his wife and on 05.05.2018 he received a phone calls from the father-in-law of his son that his son and his wife has gone to Giriyak Bazar and on the way his son lost and thereafter, the informant along with others tried to search him, but later on, he came to know that the dead body of his son was kept in the hospital and he went there and found the dead body of his son and he has apprehension that deceased was killed by his wife and others including the petitioners as she has illicit relationship with

Submission of the learned counsel for the petitioners is that they are the ladies and petitioner no.1 is mother-in-law and petitioner no.2 is sister-in-law of the deceased. Further, no specific allegation has been attributed against them during the investigation.

Having heard both sides, considering the fact that no specific allegation has been attributed against the petitioners and they are ladies, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned A.C.J. 1st Class, Biharsharif, Nalanda, in connection with Giriyak P.S. Case No. 183 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
