The petitioner has filed the instant application for grant of bail in a case registered for the offence under sections 401, 414 and 34 of the Indian Penal Code and sections 137 and 147 of the Indian Railway Act.

As per the allegation in the FIR, the petitioner along with other co-accused persons were apprehended and from the possession of the petitioner a stolen mobile is stated to have been recovered It is submitted by learned counsel for the petitioner that the mobile phone recovered from the petitioner belongs to his friend, he is in custody since 13.09.2019 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the petitioner being in custody since 13.09.2019 and having no criminal antecedent, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Magistrate, Katihar in connection with Katihar Rail P.S. Case No. 74 of 2019 (G.R. No. 137 of 2019).
