The petitioner seeks regular bail in connection with Bhitaha P.S.Case No.65 of 2019 dated 3.7.2019 registered for offences punishable under Sections 20(b)(ii)(b) of the NDPS Act Allegation against the petitioner is about recovery of 12.300 k.g. of Ganja from the house of the petitioner. Submission of the learned counsel for the petitioner is that the recovery is less than the commercial quantity and he is in custody for six months.

Heard learned A.P.P. , who has opposed the prayer for bail.

Having heard both sides and in view of the facts and

Patna High Court CR. MISC. No.77087 of 2019(2) dt.13-01-2020 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, once the charge has been framed int his case the petitioner is at liberty to renew his prayer for bail. With the aforesaid observation, this application is dismissed.
