The petitioner seeks regular bail in connection with Buxar Town P.S. Case No. 166 of 2023 instituted for the offences punishable under Section 392 of the Indian Penal Code.
As per prosecution case, the FIR has been lodged against three unknown accused persons against whom the allegation of robbery is there. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that nothing incriminating article has been recovered from the possession of the petitioner and petitioner was not put on
Patna High Court CR. MISC. No.199 of 2024(2) dt.19-01-2024 2/2 test identification parade. He next submits that similarly situated co-accused has been granted regular bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 84711 of 2023 vide order dated 10.01.2024. Petitioner is in judicial custody since 19.09.2023.
Learned APP for the State opposes the prayer for bail of the petitioner.
Considering the facts and circumstances of the case and also the fact that similarly situated co-accused has already been granted bail by co-ordinate Benches of this Court, let the petitioner above named be released on bail after framing of the charge on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Buxar Town P.S. Case No. 166 of 2023.
