2. The petitioner is in judicial custody in connection with S.T. No. 148 of 2023 arising out of Basnahi P.S. Case No. 260 of 2022 for the offence punishable under Sections 302, 120B, 34 of the Indian Penal Code and section 27 of the Arms Act lodged on 23.12.2022 by the informant, Sulekha Devi.

3. As per the prosecution story, the lady came on hearing gun shot only to find her husband, bent on chair with gun shot injury on his scalp/head. He was taken to the hospital but succumbed to the injuries.

4. The allegation in the FIR is that Nilesh Yadav had demanded ransom and as her husband failed to pay, she suspected his role. Subsequently, Nilesh Yadav was arrested and he spilled the beans which followed the arrest of accused persons which included the petitioner herein.

5. Learned counsel for the petitioner submits that Nilesh Yadav as also those whose name has come in confession has been granted bail which is part of the record as Annexure-2 series.

6. Learned APP Mr. Jitendra Kumar Singh on the other hand has drawn attention of this Court to para-3 which shows that the petitioner is accused in 33 criminal cases.

7. A coordinate bench had called for the report and the learned Sessions Judge vide letter no. 592 dated 31.1.2024 has submitted report stating that out of 12 witnesses, 8 have been examined and for the rest, non-bailable warrant issued. He has further undertaken that the trial will be taken to its logical conclusion.

8. Believing his words that the trial will come to an end soon, for the present this Court is not inclined to extend him the privilege of bail which is accordingly rejected.
