====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-02-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Deep Nagar P. S. Case No. 580/2023 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, this petitioner is alleged to have assaulted on the head of informant with the butt of pistol.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. It is further submitted that similarly situated co-accused, namely, Raju Kumar has already been granted regular bail by

Patna High Court CR. MISC. No.89441 of 2024(2) dt.21-02-2025 2/2 this Hon'ble Court vide order dated 20.12.2024 passed in Cr. Misc. No. 79279 of 2024. Petitioner is in custody since 01.09.2024 and charge-sheet has already been submitted.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Deep Nagar P. S. Case No. 580 of 2023.
