This application for anticipatory bail arises out of Dhamdaha P.S. Case No. 222 of 2019 for the offence punishable under Section 302 and other allied Sections of the Indian Penal Code.

When the matter was taken up on 18.06.2020, this Court had noticed that learned Senior Counsel appearing on behalf of the petitioner was in possession of the entire case diary. The case diary is a confidential document and the petitioner could not have legally obtained it without the same

Patna High Court CR. MISC. No.82627 of 2019(4) dt.03-07-2020 2/2 having been supplied to him by way of police papers under Section 207 of the Cr.P.C.

The fact that the petitioners or his pairvikar have been able to obtain the case diary illegally, goes to suggest that the petitioners are interfering with the course of investigation. For the said reason, I am not inclined to entertain this application, which is accordingly dismissed.

The petitioners shall be at liberty to renew his prayer for bail after six months.
