The petitioner is in custody in connection with Baikunthpur P.S. Case No. 238 of 2018 for the offences under Sections 302/34 of the Indian Penal Code and Section 27 of Arms Act.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 10.09.2018.
Referring to the prosecution case he submits that the father of the informant disclosed the name of the accused persons, who caught and shot him. The injured was rushed to Baikunthpur Govt. hospital from where the injured was referred to Tara Nursing Home for better treatment where he was
Patna High Court CR. MISC. No.19348 of 2019(3) dt.29-05-2019 2/2 declared dead by the doctors.
Learned counsel for the petitioner further submits that there is no specific allegation against this petitioner of firing and causing injury to the deceased.
Considering the fact that petitioner has no criminal antecedent and he has remained in custody for more than eight months, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Chief Judicial Magistrate, Gopalganj in connection with Baikunthpur P.S. Case No. 238 of 2018.
