Petitioner seeks bail in a case registered for the offence punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.
Co-accused Topariya Singh, standing on similar footing to that of the petitioner, has already been allowed bail by a Coordinate Bench of this Court vide order dated 17.08.2019 passed in Cr. Misc. No. 31689 of 2019. Allegation is that informant saw that the petitioner and Topariya Singh caught to the son of the informant and another co-accused fired causing his death. Petitioner is in custody since 15.05.2019. Investigation of the case is already complete. There is no allegation of tampering with the evidence.
Hence, let the petitioner, above named, be released on
Patna High Court CR. MISC. No.79911 of 2019(2) dt.05-12-2019 2/2 bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S. Tr. No. 912/2019 arising out of Maranchi Police Station Case No. 70 of 2018, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
