JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-12-2019 This application, for grant of anticipatory bail, arises out of Forbesganj P.S. Case No. 419 of 2018, disclosing offences under Sections 386/34 of the Indian Penal Code. Allegation as per written report of the informant is that petitioner took away the motorcycle of the informant and demanded Rs. 40,000/- as extortion.
Submission of learned counsel for the petitioner is that as a matter of fact that motorcycle in question was purchased by the brother of petitioner from the informant, however, thereafter, some dispute arose and this present false case has been lodged. Further submission is that now the compromise has been reached between the party and an application to that effect has been filed before the learned Chief Judicial Magistrate, which is also the part of F.I.R.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -VI, Araria, in connection with Forbesganj P.S. Case No. 419 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
