The petitioner, being the husband of the complainantopposite party no. 2, was granted provisional anticipatory bail in Complaint Case No. 2493© of 2015 vide order dated 21.02.2019 wherein at page 2 it was recorded that "vide order dated 23.05.2017 passed by learned Additional Principal Judge, Family Court, Patna in Maintenance Case No.139(M) of 2015 directed for payment of maintenance amount of Rs.7,000/- per month from 22nd June, 2017 of every succeeding month along
Patna High Court CR. MISC. No.62769 of 2018(6) dt.15-05-2019 2/2 with Rs.3,000/- as litigation cost. However, from the order passed in Maintenance Case No. 139(M) of 2015 it appears that Rs.7,000/- per month was granted to the complainant and Rs.3,000/- per month to the daughter of the complainant, though, the order was made effective from 22.06.2017 and apart from the above mentioned maintenance amount Rs.10,000/- was also awarded as one time litigation cost.
Accordingly, the order dated 21.02.2019 is modified to the extent that the petitioner was directed to make payment of Rs.7,000/- per month to the complainant and Rs.3,000/- to the daughter of the complainant from 22.06.2017 and apart from that Rs.10,000/- was also awarded as one time litigation cost. Let the order be transmitted to the Court of learned Chief Judicial Magistrate, Patna in connection with Complaint Case No. 2493© of 2015.
