The petitioner seeks bail in Nagar P.S. Case No.355 of 2018 registered for the offence under Sections 413, 414/34 of the I.P.C.
Accusation is that in course of checking of vehicles one Apache Motorcycle without registration number plate was seen rashly coming from Kalambagh chowk and when the informant being A.S.I. of Nagar Police Station, asked them to stop both persons started to flee away but on chase they were apprehended and on query they could not produce any paper regarding the motor cycle. On verification the said motor cycle was found registered in the name of Sanjiv Kumar Suman S/o Binod Prasad
Patna High Court Cr.Misc. No.62355 of 2018 (2) dt.06-10-2018 2/2 Singh, P.O.Bhuly, P.S. Parsauni, Distt.-Sitamarhi, having its registration No.BR-305-3148. On further query they disclosed that the said motor cycle was looted regarding which Dumra P.S.Case No.91/18 was instituted on 7.3.2018 under Section392 of I.P.C. Submission on behalf of the petitioner is that the petitioner was apprehended on mere suspicion and he is in custody since 19.05.2018 having no criminal antecedent. Heard the learned A.P.P. also who opposed the prayer for bail of the petitioners.
Considering the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Muzaffarpur, in Nagar P.S. Case No.355/18.
