The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 498A/323/341/506/406/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
Opposite Party No.2 Priya Devi claims to be the wife of the petitioner. Opposite Party No.2 had filed Complaint Case No.517 of 2015, at Annexure-5, against Krishna Kumar Pal and others alleging therein that she was in physical relation with Krishna Kumar Pal on the pretext of marriage. Submission is that a day after marriage the victim fled away from the house of the petitioner as she had some affair
Patna High Court Cr.Misc. No.63047 of 2018(2) dt.29-11-2018 2/2 with Krishna Kumar Pal and she is still not willing to live with the petitioner.
Considering the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Mahila (Sasaram) Police Station Case No. 8 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
