1. Heard the parties.

2. The petitioner seeks regular bail in connection with Sultanganj P.S. Case No. 168 / 2024 registered for the offence under Section 376 of the I.P.C. read with Section 67, 67(A) of the I.T. Act

As per the prosecution case the informant has given written report to the S.H.O., Sultanganj Police Station alleging therein that the petitioner / Keshav Kumar @ Ankit Kumar is the friend of her brother, who died in a road accident on 15.02.2022. During the CTET examination on 12.01.2023 at Patna the informant arrived at Patna and called the petitioner. She was taken to the room of the petitioner at Pathar Ki Masjid

No.86445 of 2024(4) dt.06-08-2025 2/3 where the informant stayed, took bath and meal and from that day the petitioner started regularly calling the informant enquiring about her where about. When the informant started neglecting the petitioner, the petitioner arrived at the house of the informant, showed a video in which she was taking bath in naked condition. The video was taken during the time the informant stayed at the room of the petitioner. The petitioner allegedly pressurized the informant to make physical relation with him otherwise the video would be made viral by the petitioner. On 15.08.2023 the petitioner called her and told her to meet at his room in Patna then he would delete the video and when the informant went to his room she was raped and once again he made a video of the informant and on the basis of that video he continued to make physical relation with her.

Mr. Vindhkeshri Kumar, learned senior counsel for the petitioner submits that there is inordinate delay in lodging the F.I.R. inasmuch as the occurrence according to the informant has taken place on 12.01.2023 and subsequently on 15.08.2023 however the F.I.R. has been lodged on 25.04.2024. There was cordial relationship between the petitioner and the informant and the informant used to stay in the room of the petitioner. If any relation was made that was consensual in nature between

5. On the other hand, Mr. Akshay Lal Pandit, learned counsel for the State submits that the statement of the victim girl was recorded under Section 164 Cr.P.C. in which she has supported the prosecution story.

6. Notice was issued to the informant / opposite party no. 2.

7. Learned counsel appearing for the informant submits that informant does not want to oppose the bail of the petitioner. The petitioner is in custody since 30.07.2024 and charge sheet has already been submitted.

8. Considering the aforesaid submission, the present application is disposed with a direction that the petitioner shall be released on bail after framing of charge by the lower court itself.
