2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 302, 120B, 504 and 506 of the Indian Penal Code.
3. As per prosecution case, this petitioner along with other FIR named accused persons, armed with lathi and danda etc. abused and assaulted the informant and his father, as a result of which father of the informant died during the course of treatment.
4. Learned counsel for the petitioner submits that there is general and omnibus allegation of assault against the petitioner. The FIR has been lodged against 20 named and four
Patna High Court CR. MISC. No.90382 of 2024(7) dt.14-11-2025 2/2 to five unknown persons, but as per post-mortem report the deceased sustained only three injuries. Petitioner has got one criminal antecedent.
5. Learned APP for the State has opposed the prayer for anticipatory bail and submitted that this petitioner is named in the FIR and there is specific allegation that he along with other co-accused persons has assaulted the informant and his father, as a result of which informant's father died during the course of treatment. He further submitted that anticipatory bail application of a similarly situated co-accused persons namely, Sanjay Singh has also been rejected by this Court vide order dated 27.09.2022 passed in Cr. Misc. No. 16903 of 2022.
6. Considering the facts and circumstances of the case as well as the heinous nature of offence, the prayer for grant of anticipatory bail to the petitioner is rejected.
7. Accordingly, the present anticipatory bail application stands dismissed.
