1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Beldour P.S. Case no. 339 of 2020 registered under section 394 of the Indian Penal Code.

3. As per the prosecution case, four accused persons on two motorcycles are said to have assaulted and robbed the informant of Rs. 37,172/- in cash which he was carrying.

4. Learned counsel for the petitioner submits that the F.I.R was registered against unknown accused persons. Referring to the contents of the petition and especially the order of the learned trial Court it is submitted that the name of the

No.4813 of 2024(2) dt.07-02-2024 2/3 petitioner transpired in the confessional statement of co-accused Gautam Kumar who has been himself enlarged on bail vide order dated 21.1.2022 passed in Cr. Misc. no. 40277 of 2021. No incriminating article has been recovered from the petitioner's possession and the prosecution is mainly relying on the confessional statement of the co-accused as also that of this petitioner. The petitioner is in custody since 30.5.2023 and charge-sheet has been submitted in the case.

5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and having perused the contents of the petition, taking into consideration the allegations in the F.I.R, the name of the petitioner transpiring in the confessional statement of coaccused who has himself been enlarged on bail by the aforesaid order dated 21.1.2022, no incriminating article having been recovered from the petitioner's possession, his being in custody for more than 8 months since 30.5.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Beldour P.S. Case no. 339 of 2020, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
