JUSTICE ARVIND SRIVASTAVA ORAL ORDER 25-11-2021 Heard learned counsel for the petitioner, learned for the informant and learned A.P.P. appearing for the State. The petitioner apprehends his arrest in connection with Budha Colony P.S. Case No. 205 of 2019 registered under Section 498A/34 of the Indian Penal Code and section 3⁄4 of the Dowry Prohibition Act.
Learned counsel appearing on behalf of the petitioner submits that both the parties have entered into compromise the case and to that effect, filed a compromise petition on 18.11.2021 undertaking that they are living in the matrimonial house with child and opposite party no.2/informant
Patna High Court CR. MISC. No.77374 of 2019(6) dt.25-11-2021 2/2 is presently pregnant. Further, he submits that there is no need to remand this case to reconciliation centre.
Having considered the above facts and circumstances of the case and also undertaking of both the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Sub-Judge-XVI-cum-A.C.J.M., Patna in connection with Budha Colony P.S. Case No. 205 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
