JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2020 Petitioner seeks bail in connection with Durgawati P.S. Case No. 218 of 2019, registered for the offences punishable under Sections 302, 201, 34, 396, 412 and 120B of the Indian Penal Code.

As per prosecution case, one dead body was recovered on the basis of statement of informant-Choukidar and it appears that he was killed by some persons and later on during investigation name of petitioner has transpired along with other accused persons. It further appears from the impugned order that one co-accused was examined during investigation and in his statement recorded under Section 164 Cr.P.C. he has named this petitioner and apart from that two other accused persons have been identified in TIP also and there is self confession of the petitioner.

Patna High Court CR. MISC. No.77117 of 2019(3) dt.06-03-2020 2/2 Submission of learned counsel for the petitioner is that except his confessional statement and confessional statement of co-accused there is nothing against him and he is in custody for five months.

Heard learned APP, who has opposed the prayer for bail stating that it is a case of murder and loot and his name also transpired in the statement of co-accused under Section 164 Cr.P.C.

In view of above facts and circumstances, I am not inclined to grant bail to the petitioner.

This application is dismissed.

However, let the trial be expedited.
