2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 25 (1-B)a, 26 and 35 of the Arms Act.
3. The case of the prosecution is that from the possession of this petitioner, a bike and smartphone were allegedly recovered. Thereafter, the police recorded his confessional statement and on the basis of said confession, recovered a sum of Rs. 5,84,500/- , a butt of gun and 99 live cartridges from the house of the petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that

It is further submitted at the time of seizure, the police dis not comply with the provisions of Section 105 of the Cr. P.C. and that all the seizure list witnesses are police personnel. Moreover, the petitioner is languishing in judicial custody since 20.09.2025.
5. Learned APP appearing for the state has opposed the prayer of regular bail submitted that the petitioner possesses two criminal antecedents.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Manikpur P.S. Case No. 82 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-1st, Arwal.
