2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 8(C), 17(C), 18(C), 21(C), 25, 29 and 31 of the NDPS Act.

3. The case of the prosecution in short is that three persons were in a vehicle and from possession of this petitioner altogether 424 gm. and from two other persons, 205 gm. and 444 gm. of opium was recovered. Altogether 1.073 kg of opium was recovered.

4. Learned counsel for the petitioner has submitted that from possession of this petitioner only 424 gm. of opium has been recovered which is more than small quantity but is much less than the commercial quantity. Learned counsel for the petitioner has submitted that the petitioner is languishing in

Patna High Court CR. MISC. No.83059 of 2025(2) dt.10-12-2025 2/2 judicial custody since 05.06.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner and has submitted that the petitioner is having criminal antecedent of similar nature.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with G.R. Case No. 89 of 2025 arising out of Dhaka P.S. Case No. 280 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, East Champaran, Motihari.
