====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-12-2018 The petitioner seeks bail in connection with T.R.No. 1999 of 2017 arising out of Dehri (Town) P.S.Case No. 592 of 2016 registered under Sections 120B, 379 and 408 of the Indian penal Code.

Allegation against the petitioner is of withdrawing Rs. 85,000/- by stealing ATM cards and PIN of different persons It appears that prayer of bail earlier was rejected vide order dated 22.06.2017 passed in Cr. Misc. No. 18093 of 2017 and again vide order dated 25.04.2018 passed in Cr. Misc. No. 14377 of 2018 by a co-ordinate Bench of this Court.

Submission of learned counsel for the petitioner is that petitioner has remained in custody for two years and there is no chance of conclusion of trial in near future.

Heard the parties. From perusal of report dated 03.12.2018, it appears that charge has been framed but in spite of several dates being given, the prosecution has not produced a single witness till date to record his evidence. In such view of the matter, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Dehri-On-Sone (Rohtas) in connection with T.R. No. 1999 of 2017 arising out of Dehri (Town) P.S. Case No. 592 of 2016 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and he shall appear before the trial court as and when required and in the event of failure to appear on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bond.
