The petitioner seeks regular bail in connection with Bettiah (T) P.S.Case No.98 of 2006 instituted for the offences punishable under Section 392 of the Indian Penal Code. FIR of the occurrence of robbery is against unknown. Petitioner is in custody since 28.05.2019. Investigation of the case is already complete.
Submission is that petitioner was never put on test identification parade nor anything was recovered from his possession.
Considering the aforesaid facts, let the above named petitioner be released on regular bail on furnishing bail bond of
Patna High Court CR. MISC. No.82088 of 2019(2) dt.18-12-2019 2/2 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Bettiah, West Champaran/successor Court/transferee Court in connection with Trial No.6106 of 2019 arising out of Bettiah (T) P.S.Case No.98 of 2006, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
