JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-03-2020 The petitioner, who is in custody since 17.10.2019, seeks bail in connection with Kankarbagh P.S. Case No. 1013 of 2019 (Spl. Case No. 9195 of 2019) dated 16.10.2019 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act. 209.625 litres of liquor is said to have been recovered from a joint house in which, apart from the petitioner, other persons also reside.

The learned advocate for the petitioner has submitted that the accusation against the petitioner is absolutely false. In support of aforesaid contention, it has been pointed out that prior to lodging of the present case, the petitioner has not been made accused in any case whatsoever.

Regard being had to the nature of accusation

Patna High Court CR. MISC. No.78666 of 2019(3) dt.16-03-2020 2/2 against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Kankarbagh P.S. Case No. 1013 of 2019 (Spl. Case No. 9195 of 2019).
