In this case, the petitioner is seeking anticipatory bail in connection with Khudwan P.S. Case No. 24 of 2019, registered for the offence under Sections 30(a) and 38(2) of the Bihar Prohibition and Excise Act.

A Bolero car bearing registration no. BR 02AD 6473 has been intercepted by the Police, from there one of Royal Stage whiskey containing 375 ml. wine has been recovered.

Learned counsel for the petitioner submits that the petitioner was not the occupant but, was the owner of the vehicle. He further submits that the petitioner has no criminal antecedent.

No.77166 of 2019(2) dt.27-11-2019 2/2 Looking to the quantum of liquor recovered from the vehicle as well as the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VII-cum- Special Judge (Excise), Aurangabad, in connection with Khudwan P.S. Case no.24 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. This is also subject to the condition that if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of bail of the petitioner.
