Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code, Section 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.
Allegation is that ten litres of liquor was recovered from the courtyard and 200 litres of raw material was recovered from nearby the house of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent. He is in custody since 16.09.2019. Investigation of the case is already complete against the petitioner.
Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the
Patna High Court CR. MISC. No.79917 of 2019(2) dt.05-12-2019 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Janta Bazar Police Station Case No. 151 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
