2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 143(1), 145, 98 and 3(5) of B.N.S., Sections 8 and 12 of the POCSO Act and Sections 3, 4, 5 and 6 of the Immoral Trafficking (Prevention) Act, 1956.
3. The case of the prosecution is that on the basis of the information received regarding minor girls being kept for illegal purposes, a raid was conducted at the orchestra of this petitioner and from there, two girls were recovered.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.83653 of 2025(2) dt.11-12-2025 2/3 petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that there is no allegation against this petitioner that he has misbehaved with any of the girls. From perusal of the order of the learned trial court, it will transpire that the girls who have been recovered from the orchestra of this petitioner, they have given their statement recorded under Section 183 of the B.N.S.S. wherein they have stated that both were working in orchestra. Learned counsel for the petitioner has further submitted that other coaccused persons have been granted bail by this court and from learned co-ordinate Bench of this Court vide order dated 27.08.2025 and 14.10.2025 passed in Cr. Misc. Nos. 58521 of 2025 and 70971 of 2025. The case of this petitioner stands on similar footing. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, the petitioner is languishing in judicial custody since 25.09.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named
Patna High Court CR. MISC. No.83653 of 2025(2) dt.11-12-2025 3/3 petitioner is directed to be released on bail in connection with Saran Mahila P.S. Case No. 46 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Additional Sessions Judge (POCSO) Saran at Chapra with the condition that the petitioner will give an affidavit that henceforth, he will not engage himself in the running of any orchestra.
