2. The petitioners apprehend their arrest in a case registered for the offence punishable under Section 135 of the Electricity Act read with Sections 341, 323, 504 and 34 of the Indian Penal Code.

3. It is a case of electricity theft.

4. From bare perusal of the impugned order it appears that petitioners were ready to pay the fine amount imposed by the department.

5. However, at this stage, petitioners have refused to

Patna High Court CR. MISC. No.89584 of 2024(3) dt.29-01-2025 2/2 pay the same and learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and has falsely been implicated in this case.

6. On the other hand, learned A.P.P. for the State and learned counsel appearing on behalf of the electricity department have vehemently opposed the prayer for grant of anticipatory bail to the petitioners and submitted that these petitioners were consuming electricity despite disconnection of electric supply and thereby caused huge revenue loss. It is further alleged that they also assaulted informant and his team members.

Considering the aforesaid facts and circumstances, nature of accusation and the fact that petitioners have refused to pay the amount of fine imposed by the department and have assaulted informant and others, the prayer for grant of anticipatory bail to the petitioners is rejected.
