====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-01-2019 Heard the learned counsel for the petitioner and the State.

The petitioner seeks bail in anticipation of his arrest in connection with Rahui P.S. Case No. 26 of 2018 dated 02.02.2018 instituted for the offences under Sections 419, 420, 467 and 468 of the Indian Penal Code.

The informant who is a Revenue Karamchari of Rahui circle has alleged that for obtaining a certificate regarding the family tree of the petitioner, a false statement was made, showing himself as son of one Uday Pandey.

Learned counsel appearing for the petitioner has submitted that there was no intention to provide any wrong information to the Revenue

Patna High Court Cr.Misc. No.71784 of 2018(3) dt.09-01-2019 2/2 Karamchari/informant. in fact, late Uday Pandey is nonelse but the uncle of the petitioner who had adopted him during his lifetime. In that view of the matter a statement was made by the petitioner that Late Uday Pandey is his father. In the application, the petitioner had himself stated that he is the adopted son of aforesaid Uday Pandey. This very fact reflects that there was no intention of the petitioner to obtain the certificate of family tree on wrong set of facts.

Considering the aforesaid aspect of the matter, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda, Biharsharif in connection with Rahui P.S. Case No. 26 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
