JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-03-2020 The petitioner who is in custody since 16.09.2019 seeks bail in connection with Kotwali P.S. Case No. 435 of 2019 instituted for the offences under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-B) a, 26, 35 of the Arms Act.

The petitioner is said to have been apprehended while making preparation for committing crime. One loaded country made pistol is said to have been recovered from his possession.

The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case because of his past antecedents.

Considering the period of custody and the nature of accusation, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousands) with sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Kotwali P.S. Case No. 435 of 2019.
