2. The petitioner apprehends arrest in a case registered under Sections 274, 275, 3(5) of the Bhartiya Nyaya Sanhita and Section 30(a) of Bihar Excise Act.
3. As per prosecution case, 360 liters illicit liquor was recovered from two motorcycles and one newly constructed house of Vinod Kumar Yadav.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner has been made accused in this case merely because he happens to be father of co-accused Vinod Kumar Yadav. Nothing has been recovered from the conscious possession of the petitioner. Petitioner has got one criminal
Patna High Court CR. MISC. No.88548 of 2024(2) dt.20-01-2025 2/2 antecedent of similar nature in which, he is on bail.
5. Learned A.P.P. for the State opposed the prayer for bail.
6. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs. 10,000 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge Excise, Madhubani in connection with Khajauli P.S. Case No. 226 of 2024, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023.
