2. The petitioner seeks bail in connection with Bagengola P.S. Case No. 76 of 2023 registered for the offence under Section 363 and 366(a) of the Indian Penal Code.

3. As per the prosecution case, the petitioner is said to have abducted the victim girl.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case and the victim girl in her statement made under Section 164 of the Cr.P.C. has said that she had eloped with the petitioner on her own.

5. It is also submitted by the learned counsel for the petitioner that the petitioner is in jail since 28.06.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts and the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VI-cum-Special Judge, POCSO Court, Buxar in connection with Bagengola P.S. Case No. 76 of 2023.
