The petitioners seek bail in connection with Bodh Gaya P.S. Case No. 515 of 2022 instituted for the offence under Sections 147, 148, 149, 337, 338, 353, 504 & 506 of the Indian Penal Code and 27 of the Arms Act.

The allegation against the petitioners are of pelting stones and bricks on the police official and also creating hindrance from discharging their official duty. 4.

It has been submitted on behalf of the petitioners that the petitioner No. 1 had surrendered and is in custody since 22-08-2023, while petitioner No. 2 is in custody since 19-08-

Patna High Court CR. MISC. No.2424 of 2024(2) dt.29-01-2024 2/2 2023. Petitioner No. 1 bears one criminal antecedent while petitioner No. 2 bears two criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application. 5.

It has been further submitted by the petitioners counsel that petitioners have been falsely implicated in the present case. In fact, there are general and omnibus allegations levelled against the petitioners.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners. 7.

Considering the aforesaid facts and circumstances of the case and period of custody undergone by the petitioners, this Court is inclined to grant bail to the petitioners. 8.

Let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Bodh Gaya P.S. Case No. 515 of 2022.
