This application for regular bail arises out of Sonepur P.S. Case No. 438 of 2014, disclosing the offences under Sections 302/34 of the Indian Penal Code.

The petitioner is in custody since 8.6.2019. The dead body of the deceased, as per the First Information Report, was noticed lying in a water body which was identified by the informant, wife of elder brother of the deceased. The petitioner has been implicated on suspicion, there being property dispute between the petitioner's family and the family of the deceased. Except for the suspicion raised by the informant in the First Information Report, there is nothing concrete on record to

Patna High Court CR. MISC. No.78189 of 2019(2) dt.10-01-2020 2/2 suggest the petitioner's involvement in commission of the offence. It has been stated in the application that the charge sheet has been submitted on 30.07.2019.

Considering the absence of specific allegation against the petitioner's involvement in commission of offence, in my opinion, the case for grant of regular bail is made out. Considering the above, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand), with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, in connection with Sonepur P.S. Case No. 438 of 2014, subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail Bonds shall be liable to be cancelled.
