1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Sasaram (Darigaon) P.S. Case No.446/2023 dated 29.05.2023 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 342, 332, 333, 337, 338, 307, 353, 354, 224, 225, 427 and 504 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that the petitioner has antecedent of four cases and the informant alleges that the police force had gone to arrest the petitioner in Sheohar P.S. Case No.8/2019 and he was arrested also but then his family members created ruckus and even attacked the police force, as such, the petitioner taking advantage of the ruckus created fled. Patna High Court CR. MISC. No.3909 of 2024(2) dt.13-02-2024 2/2 granted the privilege of anticipatory bail in Sheohar P.S. Case No.8/2019 by an order dated 30.11.2023 in Cr. Misc. No.72332/2023. The learned counsel thus submits that since petitioner was granted the privilege of anticipatory bail in Sheohar P.S. Case No.8/2019 subsequent to the institution of the present F.I.R. that in itself demonstrates that the petitioner has been falsely implicated in the present case.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Rohtas in connection with Sasaram (Darigaon) P.S. Case No.446/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
