The petitioner apprehends his arrest in connection with Nautan P.S. Case no. 104 of 2019, registered under Sections 406, 420, 467, 468, 471 and 120(B) of the Indian Penal Code arising out of Compliant Case No. 314 of 2019. The accusation is that on 15.09.2018, while complainant/O.P. No.2 Ranjan Kumar Singh was at his door, at that time, a jeep came on which a poster was tagged regarding sending of people for abroad for livelihood, when the said vehicle stopped at his door one person came out from the said vehicle, who disclosed his name Bhola Pandit and he also informed that his brother Madan Pandit and his friend Raj Kumar Duby (petitioner) has opened a company in Dubai in

Patna High Court CR. MISC. No.77310 of 2019(4) dt.04-02-2020 2/2 which there is requirement of boys for job on of Rs. 50,000/- per month. Thereafter, complainant/O.P. No.2 came in allurement and he gave Rs. Six lakh to Bhola Pandit for employment of his brother and relatives, but in spite of much persuasion neither the job was provided to him nor money was returned.

Learned counsel for the petitioner submits that it would appear from the complaint case that petitioner has not taken money, rather the same was taken by Bhola Pandit. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Siwan in connection with Nautan P.S. Case No. 104 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
