The dispute involves in this writ application is for payment of ex gratia amount in lieu of compassionate appointment. Annexure-11 is the letter dated 14th January, 2015 whereby the claim of ex gratia amount in lieu of compassionate appointment has been rejected by the United Bank of India, now the Punjab National Bank.

Learned counsel for the petitioner submits that he is not pressing the writ application for quashing of Annexure-11 i.e. the letter dated 14th January, 2015, by which, the claim of ex gratia amount has been rejected. However, the Punjab National

Patna High Court CWJC No.20274 of 2018(10) dt.01-12-2021 2/3 Bank may consider the application for compassionate appointment of legal heirs of deceased employee late Jai Nath Verma in accordance with its scheme for compassionate appointment. Learned counsel further submits that the amount of group insurance has also not been paid to the petitioner. On the other hand, learned counsel for the Bank submits that if any application is filed by the legal heirs of the deceased employee as per the scheme, the same can be considered by the Bank in accordance with law. Having heard learned counsel for the parties, the petitioner is permitted to file a representation before the Respondent-Bank for payment of group insurance and if such a representation is filed by the petitioner, the same will be disposed by the Respondent-Bank in accordance with law within a period of two months from the date of receipt/production of a copy of this order.

In so far as claim of the petitioner with regard to the compassionate appointment, the petitioner is given liberty to file an application before the Bank in terms of the scheme and if such an application is filed by the petitioner or any other legal heirs of the deceased employee, the same will be considered by the Bank in accordance with law.
