2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 and 302 of the Indian Penal Code .
3 . As per the prosecution case , on the alleged date and time of occurrence , this petitioner who is brother of informant's husband is alleged to have pushed the husband of informant from roof and thereafter assaulted him by fists and slaps as a result of which he died.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to family feud. As a matter of fact, the husband of the informant fell from roof and he died on the spot and taking
Patna High Court CR. MISC. No.88920 of 2024(3) dt.05-02-2025 2/2 advantage of the situation , this false and concocted case has been lodged against this petitioner.
5 . Learned counsel for the State opposed the prayer for bail and submitted that there is specific allegation against the petitioner that he pushed the husband of informant from roof and thereafter assaulted him by fists and slaps as a result of which he died. Petitioner is the sole assailant.
6. Considering the nature of accusation and gravity of offence , prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
