JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-05-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Kasba P.S. Case No. 156 of 2019, registered under Sections 302 and 201 of the Indian Penal Code.
Learned counsel for the petitioner submits that on seeing the unknown male dead body by Choukidar Md. Habibuddin, Kasba P.S. Case No. 156 of 2019 was instituted on 16.08.2019 against the unknown but in course of investigation, police recorded the confessional statement of Bibi Gulista, second wife of the deceased, Md. Sanowar, who confessed that due to love affairs with Masik Alam, Masik Alam asked her to perform the marriage but she showed her inability to perform
Patna High Court CR. MISC. No.77121 of 2019(4) dt.28-05-2020 2/2 Nikah in presence of her husband then Mashik Alam told her for making arrangement to remove her husband. Thereafter Masik Alam with the help of petitioner committed the murder of her husband, Md. Sanowar. Except the confessional statement of Bibi Gulista, no tangible material has been collected by the Investigating Officer during investigation. It is further submitted that petitioner has no criminal antecedent and is in custody since 23.08.2019.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with Kasba P.S. Case No. 156 of 2019. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
