2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Compliant Case No. 630 of 2024 instituted for the offence punishable under Sections 341, 323, 504, 315/34 of the Indian Penal Code.

3. As per prosecution case, petitioner along with coaccused have assaulted the informant be means of lathi, danda and iron rod and abused him.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.86424 of 2024(2) dt.18-01-2025 2/3 petitioner are quite innocent, and has falsely been implicated in the instant case, further this case is only based on complaint case. It is next submitted that there is no specific allegation against the petitioner whereas, it is general and omnibus. It is next submitted that petitioner has got no criminal antecedent as stated in para 3 of the bail petition.

5. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.

From perusal of the complaint petitioner and the impugned order of the learned Additional Sessions Judge-cumSpecial Court, Siwan dated 24.09.2024, it appears that on the basis of complaint petition and after inquiry the learned Magistrate taking cognizance and issuing process for offence under Sections 341, 323, 504, 315/34 of the Indian Penal Code all the offences are bailable except offence under Section 315/34 of the Indian Penal Code and from perusal of the complaint petition and the impugned order, it appears that any injury report/ medical report have not been placed on record regarding offence under Sections 315/34 of the IPC and similarly situated co-accused persons namely Sushila Devi, Punam Kumar, Indu Devi and Renu Devi have been granted anticipatory bail by this Court in Cr. Misc. No. 82099 of 2024 vide order dated

No.86424 of 2024(2) dt.18-01-2025 3/3 04.12.2024 respectively, so considering all these aspects let the petitioner above named in the event of his arrest or surrender before the Court below within six weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 2nd Class, Siwan in connection with Compliant Case No. 630 of 2024 subject to the condition laid down under Section 438(2) of Cr.P.C.
