2. The petitioner has prayed for bail in connection with Cyber P.S. Case No. 1507 of 2025 registered for the offence punishable under Sections 318(2), 318(4), 319(2), 336(2), 336(3), 111(3), 340(2), 61(2) of the B.N.S., 2023 and Sections 66(c), 66(D) of the I.T. Act.
3. The case of the prosecution in short is that the informant received secret information that at the house of Babita Devi, on the second floor, certain miscreants are indulged in cyber fraud. It is alleged that on this information police reached there, and from the room, three persons were apprehended. They were identified as Kundan Kumar, Sameer Kumar (the
Patna High Court CR. MISC. No.83987 of 2025(2) dt.12-12-2025 2/3 petitioner), and Abhiraj Kumar. It is further alleged that from that room, 13 mobile phones, one laptop, 15 ATM cards, and cash of Rs. 22,700/- were recovered.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Learned counsel for the petitioner submits that no recovery has been made from the possession of this petitioner; rather, the recovery was made from the room. One co-accused, namely, Kundan Kumar, has taken that room on rent. There is no allegation against the petitioner that he has committed cyber fraud with anyone. It is only the confessional statement of the accused persons that they are indulged in cyber fraud, but there is no specific allegation against this petitioner. It has also been submitted that the co-accused, namely, Kundan Kumar, has also been granted bail by this court. The case of this petitioner stands on similar footing. Moreover, a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 30.06.2025.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and
Patna High Court CR. MISC. No.83987 of 2025(2) dt.12-12-2025 3/3 considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned J.M.F.C.-III, Patna in connection with Cyber P.S. Case No. 1507 of 2025.
